Joseph Sutherland1,2,3

d. before 5 October 1801
Marriage*before 12 April 1761He married Judith Appleberry before 12 April 1761 in Goochland County, Virginia. They very likely married about a year before that date because, unfortunately, the marriage date reported for them in The Douglas Register is incorrect, and is actually the date of birth of the oldest of their children found in the birth and baptism section of the Register starting on page 150.1,2,3
Will*7 March 1801He prepared his will dated 7 March 1801 in Albemarle County, Virginia, naming his wife, Juda Sutherland, and only two of their children, his widowed daughter, Susannah Myers, and his only son, Joseph Sutherland. He appointed his son Joseph and his son-in-law, Zachariah Emmerson, husband of his daughter Dianna, who, along with his other daughters, was not named. What follows is our transcription of Joseph Senior's will:

In the name of God Amen, I Joseph Sutherland Sr. of the County of Albemarle and State of Virginia, being in a low state of health but of perfect mind and memory, do make this my last will and testament. First of all I do commit my body to the earth, to be buried in a decent manner and my Soul to God who gave it in hope of a glorious Resurrection. Touching my worldly property after the paying out of my just debts, I dispose of that in the following manner.

It is my will that my wife Juda Sutherland be in peaceable possession of all my estate during her natural life and that my daughter Susanna Myers and her children live with her mother, and have a maintenance, as long as she remains a widow, and no longer.

It is my will that on the decease of my wife, what of my estate remains, whether lands, stock, household furniture, etc. be sold and equally divided amongst my children, counting in what any one of them may have received, and here I take the opportunity to mention that my son Joseph Sutherland has already received £37 3s and one hogshead of tobacco which I sold to Mr. A. Hart at $7 per hundred which he has to account for. I further mention that James Claybrook has had a bed and a house extraordinary which he is to account for at the price of £25.

I do appoint my son Joseph Sutherland and Zachariah Emberson (sic) as the Executors of this my last will.

That this is my last will and testament, witness my hand and seal this 7th day of March in the year of our Lord 1801, and his will was signed with the X mark of Joseph Sutherland and sealed in the presence of witnesses, William Irvin, Robert Garland and John Wilkinson.1,2
Death*before 5 October 1801He died before 5 October 1801, the date his will was proved in Albemarle County, Virginia.1,2
Probate*5 October 1801The will of Joseph Sutherland Sr., deceased, was produced in court and proved on 5 October 1801 by the oaths of Robert Garland and John Wilkinson, two of the subscribing witnesses, and Zachariah Emmerson and Joseph Sutherland, as named in the will, were appointed Executors and gave bond and security according to law.2,1

In the name of God Amen, I Joseph Sutherland of the County of Albemarle, being weak in body but of sound mind and memory, do make this my last will and testament in words and form following, to wit:

First, after all my just debts are paid, I give to my beloved wife Elizabeth Sutherland one half the land I now possess and I also give to my wife…… two horses and one half of all my other stock of cattle, sheep and hogs. I also give to my wife one half of all my household and “kitchening” furniture, and I also give to my wife one half of my crop that is now growing, during her natural life.

Secondly, I give to my son Joseph Sutherland the other half of my land I am possessed of and I also give to my son Joseph Sutherland…… $800 in cash I have by me, and the balance of money I have by me I give to my wife Elizabeth Sutherland. I also give to my son Joseph Sutherland all the remainder of my houses, cattle, hogs and sheep. (Grandson) Will9 October 1828His maternal grandfather prepared his will dated 9 October 1828 in Albemarle County, Virginia, naming his sons, John Grayson and Thomas Grayson, daughters, Patsy Grayson, Elizaeth Sutherland and Susannah Tomlin, and grandson, Joseph Sutherland, whom he appointed as his Executor. Our transcription of William Grayson's will follows:

I William Grayson of the County of Albemarle and State of Virginia, being in good health and sound mind, being desirous to settle my worldly affairs before I go hence, do make this my last will and testament, revoking all other will or wills heretofore made.

My will is that after my death that all my just debts should be paid by my executor here in after named.

Item. I give and bequeath unto each of my son John Grayson’s children £5 apiece to be paid by my executor out of my estate. My reason for not naming my son John’s children in an equal division with the rest of my children is that I formerly paid money for my son that would fully make him equal with the rest of my children.

Item. I give and bequeath to my son Thomas Grayson’s children and his grandchildren an equal share of my estate with the rest of my children but the money to be continued in the hands of my executor or put to interest for them until they become of age or marry.

Item. My will is that all my estate of every description, both real and personal, be sold by my Executor and I invest in him full power to make titles to my land and the money to be equally divided between my children hereinafter named (except one chair, bed and furniture I give to my daughter Patsy Grayson) viz: Elizabeth Sutherland, Susannah Tomlin and the children and grandchildren of my son Thomas Grayson and my daughter, Patsy Grayson.

Lastly, I appoint my grandson, Joseph Sutherland, to be my Executor to this my last will and testament.

Witness whereunto I set my hand and seal this the 9th day of October 1828, and he signed and sealed William Grayson in the presence of John Field, Milton Wood, Charles A. Smith and George W. Kinsolving.8

In the name of God Amen, I Christopher Myers of the County of Albemarle and Parish of St. Ann, being in a low state of health though in perfect mind and memory do make and ordain this my Last Will and Testament in following manner and form.

First, my will is that all my just debts be paid.

Secondly, I lend unto my loving wife Susannah Myers all my estate, real and personal, during her natural life (with this exception) provided she continues in a state of widowhood. But should she marry, my will is that the whole of my estate should be taken out of her hands by my Executors hereafter mentioned, and by them kept for the benefit of my three children hereafter mentioned.

Thirdly, my will is that at the death or marriage of my said wife the whole of my estate of every description whatsoever to be equally divided between my three children, John Myers, Dicey Myers and Christopher Myers.

Lastly, I do hereby constitute and appoint my loving wife Susannah Myers my Executrix, and John Evrett and Zachariah Emmerson, my Executors to this my last will and testament, ratifying this and no other to be my last will hereby revoking and disannulling all former wills and testaments by me made.

In testimony whereof I have hereunto set my hand and seal this 8th day of May 1798, and the will was signed and sealed by Chirstopher Myers in the presence of Samuel Murrel, William Reynolds and Mark Leake.4
(Wife) CodicilBefore his death, Susannah's husband prepared a codicil to his will which was not dated and contained additional instructions. The codicil appointed his brother, Jacob Myers, as a specific-purpose Executor, and mentioned his father, John Myers, his paternal grandmother, Anna Elizabeth (Keppler) Meyer Bittenbender, and his grandmother's second husband, Christopher Bittenbender. Below is our transcription of Christopher's codicil.

Item. My will is further that whereas I conceive I am justly intitled to 50 acres land more or less left me by my late grandmother who died in or about the month of May 1792 who was formerly wife to my grandfather Myers who was father to my father John Myers who lives at Easton in the State of Pennsylvania, and which said grandmother after the death of my grandfather Myers intermarried with a certain Christopher Bittenbender and which land lays as well as my recollection serves me is about 25 or 30 miles from Philadelphia and whereas I have for some time past resided in the State of Virginia and not having it fully in my power since I have arrived at the age of discretion to go forward in order to establish my claim to said land being now weak but in perfect memory do constitute my brother Jacob Myers one of my Executors for the express purpose of going forward to establish my just right (hoping he will be assisted by my father’s connections and funds on the express condition that he puts my estate to no trouble or cost for which services I bequeath him the one half of the said land when obtained or the one half of whatever he may sell the same for in money, the other half of the money to be paid by him to my other Executrix and Executors, and by them disposed of in the same manner that my other estate, by my above will.

In witness whereof I have hereunto set my hand and seal ratifying this to be a part of my last will and testament in as full a manner as if it had been before wrote and desire it may be annexed to my will of the 8th of May 1798. [Underlined before signed: who died in or about the month May 1792]

Christopher Myers signed and sealed his codicil in the presence of witnesses, J. A. Lewis, Robert Kempton and John Phillips, who signed with his X mark.4
(Wife) Deathbefore September 1798Susannah became a widow when Christopher Myers died in or before September 1798 at about age 27.4
(Widowed Daughter) Will7 March 1801Her father prepared his will dated 7 March 1801 in Albemarle County, Virginia, naming his wife, Juda Sutherland, and only two of their children, his widowed daughter, Susannah Myers, and his only son, Joseph Sutherland. As his Executors, he appointed his son Joseph and his son-in-law, Zachariah Emmerson, husband of his daughter Dianna, who, along with his other daughters, was not named.

That this is my last will and testament, witness my hand and seal this 7th day of March in the year of our Lord 1801, and his will was signed with the X mark of Joseph Sutherland and sealed in the presence of witnesses, William Irvin, Robert Garland and John Wilkinson.2,3
