(Brother-in-Law) Estate and Land19 February 1799When probate was reopened on the estate of Ephraim Leach, Jacob's wife's brother, on 19 February 1799 in Plymouth County before Judge Joshua Thomas, the judge issued a warrant to Daniel Tolman, Ephraim Fobes and Daniel Fobes, empowering and directing them to take a view of the homestead farm that Ephraim, late of Bridgewater, had died seized of and to divide it into four equal parts or shares, first giving timely notice to all persons interested to be present if they saw cause. The men were further directed to assign and set off one share to the heirs of Ephraim's deceased sister Mehitable Leach, one share to the heirs of Ephraim's deceased sister Mercy Peterson, one share to the heirs of Ephraim's brother David Leach, also deceased, and one share to Ephraim’s sister Abigail (Leach) Keith, the wife of Jacob Keith, all in accordance with the directions in Ephraim's 1767 will. The committee was instructed by the judge to divide the shares by metes and bounds, considering quantity and quality, so that the heirs may hold their shares separately, forever. The judge ordered the men to make a return of the warrant with their doings and signatures, under oath, as soon as conveniently possible.4,5

(Added Proprietor) Land Grant1656Reverend James Keith was one of two men added later to the initial list of fifty-four original proprietors for the development of the town that would become Bridgewater, Plymouth Colony, Massachusetts (Plymouth Colony). The original list of men, most if not all from Duxbury, included John Willis, Solomon Leonard, Francis West, John Ames, John Howard, Thomas Hayward, Philip Delano, George Soule, Moses Simmons, John Alden, Christopher Wadsworth and James Lindall and was approved in 1645. When the town of Bridgewater was actually incorporated in 1656 the two new proprietors had been added and there were a total of fifty-six. Of these proprietors, only eighteen, about one-third, actually relocated and became residents of the new plantation. Reverend James Keith was granted his share and became a late addition original proprietor in 1664 when he became Bridgewater's first minister at the age of 21.

The area known as the Bridgewaters was originally inhabited by Wampanoag who called it Saughtuchquett (Satucket). In 1642 when the township of Marshfield was separated from Duxbury and became its own distinct entity, Duxbury petitioned the court for additional land “to the westward” in compensation.

The General Court granted their petition in 1645 and six trustees, Captain Myles Standish, John Alden, George Soule, Constant Southworth, John Rogers, and William Brett were appointed to divide the land. The action by the General Court was primarily an authority to purchase land, and Captain Standish, Samuel Nash, and Constant Southworth were appointed to make the purchase. The deed was signed on 23 Mar 1649.

The Bridgewater lands were divided among the inhabitants “by an agreement among themselves”. Unfortunately, there is no record to tell us how the town proceeded to agree to their division, or how, by whom, or when it was determined what residence or other circumstance should entitle anyone to a share. Biographical Info*Reverend James Keith was a Scotchman, educated at Aberdeen, Scotland and was the first minister of Bridgewater. He arrived in Plymouth Colony around 1662 at about 18 years of age and was ordained in February 1664.1 
Marriage*He married Susanna Edson, daughter of Deacon Samuel Edson and Susanna Orcutt.1
