(Heir at Law) Land Records3 August 1850A deed was prepared on 3 August 1850 in Barren County, Kentucky, which corrected and completed an earlier deed dated 21 June 1845. The earlier deed was made to carry out the Barren County Circuit Court's directive in a suit brought by Complainants Isaac D. Powell and Thomas G. Powell against Defendants Louisa Carver, the widow of Elisha Carver, and his infant children. Ruling for the Complainants, the court had directed that a certain tract of land which had been owned by Elisha Carver, deceased, and was in the possession of the Defendants, be conveyed to the Complainants, Isaac D. Powell and Thomas G. Powell. The names of two of Elisha's children, James L. Carver and Sarah F. Carver, were missing, we believe in error, from the original deed of conveyance and this second deed, which conveyed the same land, was prepared and filed as a correction of the omissions in the first.

We note that Thomas G. Powell, one of the original Complainants, had died in 1846 and his children, James A. Powell, Huldah A. Powell, Samuel R. Powell, Nelson T. Powell, William J. Powell and John V. Powell, replaced their father as Complainants with their uncle, Isaac D. Powell, in the 1850 deed, and that Sarah F. Carver, who had also died, was replaced as a Defendant by her stepmother, Louisa Carver. We also note that the line in brackets, [thence S 60 W 32 poles to a white oak and hickory], which appeared in the original deed, was omitted in the second when the copy was made. Our transcription of the second deed follows:

In a suit of Isaac D. Powell, Complainant, and Louisa Carver and others, Defendants, the Barren Circuit Court at the June Term 1850 made an order appointing William Garnett a Commissioner and directing him to convey on behalf of defendants James and Sarah F. Carver to the Complainant Isaac D. Powell and to the children and heirs at law of Thomas G. Powell, deceased, the land in the suit and 1 shilling mentioned. Said land contains 43 acres and lies in Barren County and is bounded as follows: Beginning at a sycamore and beech on Peters and Snells Creek, thence S 31 W 110 poles to a white oak and hickory [thence S 60 W 32 poles to a white oak and hickory] on Graham’s Original line, thence with the same N 23 W 66 poles to a sugar tree and beech, thence N 60 E 27 poles to two beeches on the ridge, thence N 20 E 57 poles to a gum on Clark’s line, thence with the same S 82 E 76 poles to the beginning.

Now, in consideration of the premises, I William Garnett as Commissioner do hereby convey to Isaac D. Powell and to the children and heirs at law of Thomas G. Powell deceased, to wit: James A. Powell, Huldah A. Powell, Samuel R. Powell, Nelson T. Powell, William J. Powell and John V. Powell on behalf of James and Lousia Carver the land aforesaid to the said Isaac D. Powell and others, their heirs and assigns forever. To have and to hold free from the claim of said James and Louisa Caver, and all persons claiming under them, and agree on the part of the said James and Louisa Carver to warrant and defend the title to said land to said Isaac D. Powell, Defendant, from the claim of all persons to the extent of assets descended to said James and Louisa Carver from their father Elisha, deceased. Given under my hand and seal this 3rd day of August 1850.

The signature of William Garnett, Commissioner, was sealed, and the deed was recorded in Barren County, Kentucky on 2 October 1851.3

(Legatee) Estate and Land20 May 1822On the same date of 20 May 1822 that Thomas's mother-in-law, Jane Tinsley, was allotted her Dower Rights, the Commissioners appointed by the Court in Barren County, Kentucky, submitted their estimation required for the settlement of the estate of Thomas's father-in-law, Isaac Tinsley Sr. From an examination of the papers they had received from Thomas Winn, Administrator for the estate, and from the "best evidence" they could obtain, they presented an accounting to the Court of the distribution status for each of the other legatees, Moses Tinsley, Richard Tinsley, Isaac Tinsley Jr., Thomas Tinsley, Seney (Tinsley) Powell, Thomas Powell, Colby Tinsley, Andrew Carpenter, Bennett Tinsley, Rhoda Tinsley, Frank Tinsley, Sophia (Tinsley) Turner and Aiden D. Turner. Identified as Isaac Tinsley Sr.'s heirs and their legal representatives, the group included Isaac's children, the husbands of their married daughters, an attorney for one of their sons, the heirs of a deceased son, and a trustee for one of their daughter's children. The report of the Commissioners listed specific amounts of money and personal property received and/or owning to each.

All of the couple's children, with the exception of Sophia (Tinsley) Turner, had already received a portion of their shares from the estate before this final accounting, and allotments were made by the commissioners for balances due.

Moses Tinsley's allotment was made to his heirs.

Allotments were made directly to Richard Tinsley, Isaac Tinsley Jr., Thomas Tinsley, Bennett Tinsley, Rhoda Tinsley and Frank Tinsley.

Essenith (Tinsley) Powell's allotment was made to her husband, Thomas Powell, who by law was her legal representative.

Colby Tinsley's balance due was allotted to his father-in-law, Andrew Carpenter, whom Colby had appointed his legal representative.

Frank Tinsley, as the Trustee for the children of his sister, Sophia (Tinsley) Turner and her husband Aiden Turner, received the children's allotment.9 
(Son-in-Law) Estate and Land27 June 1822Commissioners were appointed in February 1822 by the County Court of Barren County, Kentucky, to divide and allocate the lands of Thomas's father-in-law, Isaac Tinsley Sr., deceased, to his heirs or their legal representatives. The widow's Dower had previously been set aside. Three of the commissioners submitted their report, which included a sketch of the ten allotted shares, to the court on 27 June 1822. Included in the allocations were the heirs of Isaac's deceased son, Moses Tinsley, and Isaac's nine surviving children, Colby Tinsley, Richard Tinsley, Seney (Tinsley) Powell, Thomas Tinsley, Rhoda Tinsley, Francis Tinsley, Sophia (Tinsley) Turner, Isaac Tinsley Jr. and Bennett Tinsley. Because Thomas's wife, Essenith, and her sister, Sophia, were married, as was the law in those days, their allocations were made to their husbands, Thomas Powell and Aiden D. Turner, respectively, as their legal representatives. We, Alanson Trigg, James Matthews and William Edmonds, three of the Commissioners appointed by the County Court of Barren in the February Term 1822 to divide and allot to the Heirs and legal representatives of Isaac Tinsley, deceased, their respective parts in a tract of land containing 550 acres, met on the land aforesaid on the 26th of this Instant June and divided the same as follows, to wit and allocated:

No.1 to Moses Tinsley’s Heirs, Beginning at a beech and sugar tree near John Holeman’s fence and at the figure one, thence S 7 E 140 poles to a beech and white oak at 2, N 84 West 59 poles to two beeches at three, thence N 7 W 120 poles to figure 4 on the bluff of the creek, thence up the creek to the beginning, containing 55 acres.

No.2 allotted to Colby Tinsley and bounded as follows, Beginning at a beech and white oak, corner to No.1 and at figure 2, thence South 7 E 99 poles to the figure 5, a stake standing about eight feet north of a large poplar, thence North 84 West 63 poles to a stake in Turner’s field, thence N 7 W 99 poles to a stake and small dogwood at 7, thence S 84 E 60 poles to the beginning, containing 40 acres.

No.3 allotted to Richard Tinsley and bounded as follows, Beginning at a poplar in the head of a hollow at the figure 8, thence South 84 W 60 poles to two beeches at the figure 9, thence N 7 W 120 poles to figure 6, a stake in Turner’s field, thence South 84 E 63 poles to a stake, corner to No.2 and a figure 5, thence to the beginning, containing 45 acres.

The above report was sworn and subscribed before a judge on 15 July 1822, and the foregoing allotment and division of the land of Isaac Tinsley, deceased, was returned to the Barren County Court and ordered to be recorded. Land Records*8 October 1824Thomas Powell and his wife Seney sold about 62½ acres of land on Skaggs Creek, Barren County, Kentucky, to Samuel Whitney on 8 October 1824 for $250. The land had previously been owned by Isaac Tinsley Sr., the deceased father-in-law of both men, whose wives, Seney (Tinsley) Powell and Rhody (Tinsley) Whitney were sisters. The land in the transaction bordered the land of Isaac Tinsley's widow, Jane (Lee) Tinsley, the sisters' mother. Our transcription of the deed follows:

This indenture made and entered into this ___ day of October 1824 between Thomas Powell and Seney his wife of the County of Barren and State of Kentucky of the one part, and Samuel Whitney of the other part, Witnesseth that the said Thomas Powell and Seney his wife, for and in consideration of the sum of $250 current money to them in hand paid by the said Samuel Whitney at or before the unsealing and delivery of these presents, the receipt whereof they do hereby acknowledge, have bargained, sold, transferred and delivered and, by these presents, bargain, sell, transfer and deliver unto the said Samuel Whitney one certain tract or parcel of land lying and being in the County and State aforesaid, being part of the tract purchased by Isaac Tinsley, now deceased, of Thomas Elliott and bound as follows, viz:

Beginning at a stake in Mrs. Tinsley’s field, corner to Lot 4 and 5, running thence S 84 degrees W 57½ poles to an ash and beech, thence S 12 degrees E 140 poles to two hickories on Skaggs Creek, thence down the same, with the meanders thereof, to a hornbeam and hickory, N 34 degrees E 81 poles to a small beech, N 42 degrees W 35 poles to two beeches and sugar tree, thence N 42 degrees W 27 poles to three beeches, and thence N 5½ W 92 poles to the beginning, including by estimation 62½ acres more or less. To have and to hold the said land and premises with all and singular the appurtenances thereunto belonging unto the said Samuel Whitney, his heirs and assigns forever.

In testimony whereof they have hereunto set their hands and seals, the day and year first in this indenture written. The signature of Thomas Powell was sealed and Seney Powell’s signature was sealed with her X mark. The deed was recorded on 6 October 1824 in Barren County, Kentucky.11

Powell and Thomas G. Powell of the second part, regarding a suit that had been brought by the Powells against Louisa Carver and the infant children of Elisha Carver, deceased. We note that only six of the children, Emily Carver, Lucy Carver, Elizabeth Carver, Martha Carver, John Carver and Mary T. Carver, were named, and that James L. Carver and Sarah F. Carver, also infant children of Elisha Carver, were not. Our transcription of the deed follows:

This indenture made and entered into the 21st day of June 1845 between William Garnett, a Commissioner appointed by the Barren Circuit Court, on the one part, and Isaac D. Powell and Thomas G. Powell of the second part, Witnesseth that whereas by a decree of the Barren Circuit Court, ordered at the June Term 1845 in a suit between the said Powells, Complainants, and Louisa Carver and others, Defendants, William Garnett was appointed a Commissioner and directed to convey to the Complainants by deed with general warranties all the right, title and interest which said infant defendants, to wit: Emily Carver, Lucy Carver, Martha Carver, Elizabeth Carver, John Carver and Mary T. Carver have in and to the tract of land in the suit and exhibit mentioned. Said land is described in the exhibit filed in said cause to be bounded as follows, to wit: Beginning at a sycamore and beech on Peters and Snells Creek, thence S 31 W 110 poles to a white oak and hickory, thence S 60 W 32 poles to a white oak and hickory on Graham’s Original line, thence with the same N 23 W 66 poles to a sugar tree and beech, thence N 60 E 27 poles to two beeches on the ridge, thence N 20 E 57 poles to a gum on Clark’s line, thence with the same S 82 E 76 poles to the beginning, containing 43 acres more or less.

Now, in consideration of the premises, and for the further consideration of $86 acknowledged in said exhibit, to have been paid to the ancestor of said infant defendants, I William Garnett as Commissioner on the part of said infant defendants, do hereby convey to the Complainants, all the right, title and interest which said infant defendants, Emily Carver, etc., have in and to the above-described land, to the Powells, their heirs and assigns forever. To have and to hold the same free from the claim or claims of the said infant Carvers and all other persons. In witness whereof, I as Commissioner, do hereunto set my hand and seal the day and year aforesaid.

The signature of William Garnett, Commissioner, was sealed, and the deed was recorded in Barren County, Kentucky in July 1845.4

Wilbur was 28 years of age and an engineer at a gas plant, and Mattie was 27 years of age and a teacher in a private school. They rented their house and had two children who were enumerated with them. Lorraine L. was 6 years old and attending school, and Robert M. was 2 years old.2 
Census US 1930*4 April 1930Mattie and Wilbur G. Powell were enumerated on the 1930 census taken on 4 April 1930 at 3004 Avenue B, Fort Worth, Tarrant County, Texas. Wilbur was 38 years of age and worked as a station engineer in the wholesale produce industry, and Mattie was 38 years of age and worked as an educational saleslady. Both worked for wages. Wilbur had been 20 years old, and Mattie age 19, when they married. They rented their house for $20.00 per month and were enumerated with their two surviving children in 1930. Sons Lorraine and Robert were ages 16 and 12 years, respectively, and both were students at public schools.5 
(Father) Arrested and Charged13 November 1938His older son, Larry, age 25, and Rex Holt, 24, both residents of Cisco, were arrested on 13 November 1938 in Fort Worth, Texas, and charged with automobile theft and armed robbery of a service station. A third man, Pete Eudy, who had left the car a few minutes before Powell and Holt were arrested, later surrendered to police. The two men initially in custody readily admitted their part in the robbery, blaming whisky for their complicity. The men had stolen the car in Cisco, Eastland County, Texas and driven it to Stamford, in Jones County, Texas where they committed the robbery, then were apprehended with the car in Fort Worth.6,7,8,9,10 
(Father) Criminal Conviction4 May 1939His son's trial in connection with the Stamford service station holdup on 13 November 1938 began on Thursday, morning, 4 May 1939 in District Court, Anson, Texas. Powell was the last of the three men to appear in court. Both J. M. Eudy and Rexford Holt had been found guilty of armed robbery and had been sentenced to five years in state prison. Powell pleaded not guilty and jury selection was completed at 11 o'clock.

The State called only two witnesses, the owner of the station that was robbed, and a customer who was inside the station at the time. The owner was the first witness examined, and testified that three men entered his station the night of the holdup but was unable to positively identify Powell. The customer, who was inside the station talking to Pete Eudy, who had previously been convicted in connected with the holdup, definitely identified Powell as the third man. It was established that J. M. Eudy was also called "Pete" Eudy. He said that Powell and Rexford Holt, who had been convicted the previous day, followed the owner into the station after their car had been serviced, and the holdup followed immediately. The customer testified that Powell was the one who locked him and the owner in the men's washroom while Eudy kept them covered at pistol point and Holt looted the cash register.

The jury deliberated only 30 minutes, and returned a verdict of guilty, making Powell the third and last man convicted in the holdup. He was sentenced, as were his two accomplices, to five years in state prison.6,7,8,9,10

They rented their house for $10.00 per month and reported they had lived in the same place, Cisco, in 1935.11

(Heir at Law) Land Records3 August 1850A deed was prepared on 3 August 1850 in Barren County, Kentucky, which corrected and completed an earlier deed dated 21 June 1845. The earlier deed was made to carry out the Barren County Circuit Court's directive in a suit brought by Complainants Isaac D. Powell and Thomas G. Powell against Defendants Louisa Carver, the widow of Elisha Carver, and his infant children. Ruling for the Complainants, the court had directed that a certain tract of land which had been owned by Elisha Carver, deceased, and was in the possession of the Defendants, be conveyed to the Complainants, Isaac D. Powell and Thomas G. Powell. The names of two of Elisha's children, James L. Carver and Sarah F. Carver, were missing, we believe in error, from the original deed of conveyance and this second deed, which conveyed the same land, was prepared and filed as a correction of the omissions in the first.

We note that Thomas G. Powell, one of the original Complainants, had died in 1846 and his children, James A. Powell, Huldah A. Powell, Samuel R. Powell, Nelson T. Powell, William J. Powell and John V. Powell, replaced their father as Complainants with their uncle, Isaac D. Powell, in the 1850 deed, and that Sarah F. Carver, who had also died, was replaced as a Defendant by her stepmother, Louisa Carver. We also note that the line in brackets, [thence S 60 W 32 poles to a white oak and hickory], which appeared in the original deed, was omitted in the second when the copy was made. Ethyle M., who was 5 years old, was enumerated with her parents in 1900. A boarder was also enumerated with the family in 1900. William Wrightsman was a widow, 41 years of age and worked as a mail carrier.4
