Arrested and Charged*13 November 1938Her husband, age 25, and Rex Holt, 24, both residents of Cisco, were arrested on 13 November 1938 in Fort Worth, Texas, and charged with automobile theft and armed robbery of a service station. A third man, Pete Eudy, who had left the car a few minutes before Powell and Holt were arrested, later surrendered to police. The two men initially in custody readily admitted their part in the robbery, blaming whisky for their complicity. The men had stolen the car in Cisco, Eastland County, Texas and driven it to Stamford, in Jones County, Texas where they committed the robbery, then were apprehended with the car in Fort Worth.10,11,12,13,14 
Criminal Conviction*4 May 1939Her husband's trial in connection with the Stamford service station holdup on 13 November 1938 began on Thursday, morning, 4 May 1939 in District Court, Anson, Texas. Powell was the last of the three men to appear in court. Both J. M. Eudy and Rexford Holt had been found guilty of armed robbery and had been sentenced to five years in state prison. Powell pleaded not guilty and jury selection was completed at 11 o'clock.

The State called only two witnesses, the owner of the station that was robbed, and a customer who was inside the station at the time. The owner was the first witness examined, and testified that three men entered his station the night of the holdup but was unable to positively identify Powell. The customer, who was inside the station talking to Pete Eudy, who had previously been convicted in connected with the holdup, definitely identified Powell as the third man. It was established that J. M. Eudy was also called "Pete" Eudy. He said that Powell and Rexford Holt, who had been convicted the previous day, followed the owner into the station after their car had been serviced, and the holdup followed immediately. The customer testified that Powell was the one who locked him and the owner in the men's washroom while Eudy kept them covered at pistol point and Holt looted the cash register.

The jury deliberated only 30 minutes, and returned a verdict of guilty, making Powell the third and last man convicted in the holdup. He was sentenced, as were his two accomplices, to five years in state prison.10,11,12,13,14

(Husband) Deathbetween 1900 and 1910Frank became a widower with three young sons when Mary C. Miller died between 1900 and 1910. Their son, Keith, was born in March 1900 and Frank was enumerated as a widower in May on the 1910 census.4,3 
Census US 1910*2 May 1910Frank H. Miller was enumerated on the 1910 census taken on 2 May 1910 at 132 Huron Street, Elyria, Lorain County, Ohio. He was 41 years of age, a widower, and worked for wages as a Roll Turner in a Steel Plant. He rented his house and was able to read and write. His three sons were enumerated with him in 1910. Albert was 17 years old and worked for wages as a Drayman, driving a Dray for a Dray Line; Clifford was 14 years old; and Keith was age 10, and had attended school within the census year. All of the boys were able to read and write.4
