The property was described as one piece, parcel or tract of land lying and being in the county and state aforesaid on the waters of Skaggs and Peter's Creek and bounded as follows: beginning at a poplar on Curd's line near the corner of said Wheeler's fence, thence North 20 degrees 76½ poles (crossing the tobacco road at 53 poles) to a small mulberry, hickory, beach and black oak on a path, thence South 89 degrees East 210 poles to three black oaks and a chestnut on Doss's line, thence with said line South 48 degrees West 153 poles to a stone, thence North 73 degrees West 126 poles to the beginning, containing 100 acres. It was also understood and agreed by the parties that the said Micajah E. Wheeler and Frances, his wife, also sold and conveyed to the said Obadiah Britt a pass way 20 feet wide from the beginning corner in this deed along said Wheeler's and Curd's lines to the spring, and that the said Britt and his heirs to have a perpetual (access) to said pass way to said spring, and also to water from the spring for all necessary uses for family use and for stock to drink. The deed was signed and sealed by M. E. Wheeler and by the X mark of Frances Wheeler, and witnessed by Joseph Renfro and Obadiah's son, John W. Britt. It was proved on 9th August 1850 by the Clerk of Barren County after hearing the oaths of Joseph Renfro and John W. Britt, and by his private examination, apart from her husband, of Frances Wheeler who, after being read the contents of the deed, stated she had freely and willingly consented to it. It was recorded in Barren County on 3 September 1850.8 |
Census US 1850* | 30 August 1850 | Frances and Micajah E. Wheeler were enumerated on the 1850 census taken on 30 August 1850 in Division 1, Barren County, Kentucky. Micajah was 42 years of age and a farmer with real estate valued at $400, and Frances was 37 years of age and was unable to read or write. Micajah's eight children from his first marriage and the three children of Micajah and Frances's marriage were all enumerated in the Wheeler household in 1850. Juliann P. was 21 years of age; Mary M. and Mildred J. were ages 19 and 17 years, respectively, and had both attended school within the census year; Charles J. was 15 years old and worked as a farmer; Zerilda C. Jacintha A., Sally F. and Josephus S. were ages 13, 11, 9 and 6 years, respectively, and had all attended school within the census year. The couple's younger children, Zachariah M., Isaac V. and Hamutial H., were ages 5, 3 and one year, respectively. Thomas W. Carver was also enumerated in the Wheeler household in 1850. He was 18 years old, worked as a farmer, and would marry the Wheeler's daughter, Mary Margaret, in 1852.5,9 |
(Wife) Will | 16 January 1851 | Her husband, Micajah E. Wheeler, prepared his will dated 16 January 1851 in Barren County, Kentucky, naming his wife, Frances Wheeler, and providing for his children, born and unborn, although none were named. Micajah's primary directive was that all of his estate, both real and personal, be divided equally between his children, by both of his wives, including all that may be born to him after the preparation of his will. He directed that all of his children were to live with his wife, Frances Wheeler, who was to have charge and custody of his property during her widowhood to be used for the benefit of all the children. He directed that his estate was not to be divided until the youngest living child became of age. He did not want his gray horse or roan mare to be sold, nor one young yoke of steers, cows and heifers, hogs and sheep. He directed that all his farming tools and personal property that could be spared, be sold to pay his debts. His tobacco was to be priced and freighted by H. P. Curd, and he wanted the transaction details, for the land he had recently sold to Obadiah Britt Sr., to be completed. He wanted Joseph Renfro to act as the Executor and Cestui que trust of his estate. His will was signed and sealed by the X mark of M. E. Wheeler on 16 January 1851, and witnessed by John T. Rogers, John J. Curd and George M. Page, to the attention of: Travis Cockrill.10,11,12 |
(Wife) Land Records | 17 January 1851 | On 17 January 1851, the day after preparing his will, her husband, Micajah E. Wheeler, purchased back from Obadiah Britt Sr. the same 100 acres of land on the waters of Barren County, Kentucky, Micajah and Frances had sold to Obadiah six months earlier. Obadiah had paid $100 for the land, and Micajah paid $300 to buy it back. (Daughter) Will | 6 February 1821 | Her father prepared his will, which was written with many misspellings, on 6 February 1821 in Barren County, Kentucky, naming his wife, Betsy Wheeler, his older son, William, his daughters, Deliah, Polly and Fanny, his younger son, Micajah, and his son-in-law, Reuben Kinslow, husband of his deceased daughter, Amy. His wife, during her lifetime, was the primary beneficiary of all of his land and most of his household furniture and stock. Each of his five children, when they came of age or married, was to receive a beast, bridle and saddle, and one good bed. His instructions were clear about wanting each of his five surviving children's total share of his estate, within twelve months after his wife's death, to be made equal in value after the sale of his remaining land, household furniture and stock. He included the direction that "Delilah, Polly and Fanny is to be learnt to read and rite", and that "William and Micajah to be well educated." He gave Reuben Kinslow, widower of his deceased daughter Amy, one horse, a cow and calf, and the bed and furniture that had been Amy's in her lifetime and, at that time, was in Reuben's possession. He appointed his wife Betsy Wheeler as Executrix, and his son William as Executor to his Estate. He signed and sealed his name John Wheeler, which was witnessed by his brother, Bond Wheeler, and brothers-in-law, Pleasant Emmerson and Joseph Coleman, husbands of his sisters, Polly and Elizabeth, respectively.2 |
