(Petitioner's Witness) Divorce Filing14 September 1747Joseph was a witness for Samuel Heaton of Lebanon, Windham County, Connecticut, when Samuel petitioned the Superior Court on 14 September 1747 to grant him a bill of divorce from his wife Sarah (Hawes) Heaton. Samuel's petition stated that he was married to one Sarah Hawes on 10 December 1706, and lived with her and did all the duties of a loving, kind and faithful husband to her until sometime in the month of November 1743, at which time she departed from him to some parts of the Jersey with a design never to return and live with him again and that, without any just cause given her by the petitioner, she did then and has ever since deserted him and has not since performed any one of the duties of a wife to him and hath broken her marriage covenant, for a time period of more than three years. Joseph Phelps's confirmatory testimony, written at Hebron in September of 1748, reported that Sarah Heaton, wife to Samuel Heaton of Lebanon in the County of Windham did some time in the month of November in the year 1743 set out to go to a place called Black River "beyond York Government", as he understood, with a load of goods on her horse, and had not heard that she had returned home to her husband, and had often heard that she had not.2,3,1

First, in 1919, when Myrtle married Charley Rauls, her name was Myrtle Phelps; and second, on the 1930 census, Myrtle, who it was indicated gave the information to the census taker herself, reported that she had been 18 years old at her first marriage. She turned 18 in 1912.1,2

Burt, both of Berkley, yeoman, for the sum of $160. He used tobacco, had medium temperate habits, had completed his education after 9 years at school and could read and write. He had scars on his back, arms and hands, and a dagger tattoo on his inner left forearm. He was paroled 2 years early, with a general parole, on 19 May 1930.6

He was identified as a marijuana user, drug addict and dealer, and was released 9 months early to serve in the Army.5 
(Son-in-Law) Census US 194018 April 1940Claude W. Phillips and Birdie (Harless) Myers appeared on the 1940 census taken on 18 April 1940 in 312 Erie Street, Cleburne, Johnson County, Texas. James was 58 years of age and worked as a laborer for the government's Works Progress Administration, and Birdie was 52 years of age. They owned their home which was valued at $1,000. James had completed his education through the 8th grade of elementary school, and Birdie had completed hers through the 6th grade of elementary school. Four of the couple's children and a grandchild were enumerated with them in 1940. Daughter Ruby was 21 years of age, had completed her education through the 4th year of high school, and worked as a housekeeper for a private family; Pauline was 19 years old, had completed her education through the 2nd year of high school, and was still attending school; and son Rudolph was 13 years old, had completed the 5th grade of elementary school, and was attending school. The couple's married daughter, Eunice Myers, and her daughter, Betty Ann Phillips, were also living with the family in 1940 while Eunice's husband, Claude W. Phillips, was serving two years in prison. Eunice was 31 years of age, had completed her education through the 7th grade of elementary school, and worked as a housekeeper for a private family. Her daughter, Betty Ann, was 4 years old and had just started attending school.7
