Probate*January 1702/3 In January 1702/3 Joseph Turell petitioned the Suffolk County Probate Court, Boston, stating that his brother Daniel Turell Jr. Late of Boston, surgeon, had died intestate on board the ship Johnson, a frigate, Samuel White, Commander, in her late voyage from Barbados to New England. The document said that Daniel's wages and estate belong to Joseph, being his only brother and heir. He requested that administration be granted to their father, Mr. Daniel Turell, anchorsmith. On 2 Jan 1702/03, Daniel Turell, anchorsmith, posted a £100 bond and on the same date administration was granted to Daniel Turell, anchorsmith, for his son Joseph only heir to Joseph's brother Daniel.2 
Research Notes* The Barrell source further explained in a footnote that although Daniel seems young to have been a surgeon at 16 or 17, and Joseph seems young to have made a petition, the fact that their sister Mary was not baptized with them in 1693 suggests that they were younger than she. But it is possible that Daniel and/or Joseph were older than Mary, and that she was baptized separately (or not at all). If that was the case, then Daniel may have been born about 1676 or 1679 and Joseph may have been born about 1685.1

Turell's will gave Joseph his pictures of Oliver Cromwell, King William and Queen Mary.4

Turell's will gave Lydia (Turell) Thayer's children and their heirs a one-half part of his real and personal estate (not already disposed of in his will) to be equally divided among them.1 
(Sister) Probate Dispute2 March 1780 On 2 March 1780, Nathaniel Thayer, Cornelius Thayer, Samuel Bass, William Andrews, Deborah (Thayer) Whitworth, Hannah (Thayer) Abbott, Christian (Bass) Armstrong, Mary Thayer, Sarah (Thayer) White and Rebecca (Bass) Thomas Fowle, all of Boston and residual legatees resulting from the will of the Reverend Ebenezer Turell, submitted a document to the court addressing their concerns regarding the inequities between the value of silver and gold compared with the value of Continental currency, which had gone through several changes and devaluations during and after the Revolutionary War. In 1780, paper money in the new United States, called Continentals, was worth only about 1/40th of its face value. The document stated their understanding that Simon Tufts Esq. of Medford, as Executor to the last will and testament of Ebenezer Turell, late of Medford, Clerk, was entitled by the will to a legacy of £20, and was by virtue of his Executorship in possession of a sum of silver and gold coin, which according to a law of Massachusetts for regulating the value of silver and god coin, amounted to £503, 15s, 6p. Their petition went on to state that a dispute had arisen between the Executor Simon and several of the legatees regarding whether their legacies ought to be paid in silver and gold or in the present currency of the state. The petition's subscribers recommended that the Executor pay them 2/3 of their legacies in silver and gold, after deducting 1/2 of his own legacy, and that the Executor's other half be paid to himself in paper money. The petition went on to recommend that the £150 allowed the Executor for all his services in settling the estate be paid in paper money. The petition's subscribers, all residual legatees as the children, or their heirs, of Lydia (Turell) Thayer and Christian (Turell) Bass, both of whom were deceased sisters of the late Reverend Turell, agreed to be obligated to the court for the sum of £100,000 in lawful money of the state as protection for the Executor. Their document stated that in the case any debts owed to the estate were recovered which would increase the assets owed to the Executor, they would refund their prorated parts of those debts on the condition that their obligation of £100,000 to the court be voided and of no effect. Their petition concluded with the statement that should they fail to keep their agreement, their obligation would remain in full force and effect.1

His will gave each of the boys two hundred pounds and no more, having already been at considerable charge for their maintenance and education; and in the case that either of them were to die in his minority, then the survivor was to have the whole sum of four hundred pounds, to be paid as they, respectively, attained full age. The Reverend Ebenezer Turell, Mary's brother, was appointed Executor of their father's estate and was bonded for £3000.6

(Legatee) Estate and Land20 May 1822On the same date of 20 May 1822 that Aiden's mother-in-law, Jane Tinsley, was allotted her Dower Rights, the Commissioners appointed by the Court in Barren County, Kentucky, submitted their estimation required for the settlement of the estate of Aiden's father-in-law, Isaac Tinsley Sr. From an examination of the papers they had received from Thomas Winn, Administrator for the estate, and from the "best evidence" they could obtain, they presented an accounting to the Court of the distribution status for each of the other legatees, Moses Tinsley, Richard Tinsley, Isaac Tinsley Jr., Thomas Tinsley, Seney (Tinsley) Powell, Thomas Powell, Colby Tinsley, Andrew Carpenter, Bennett Tinsley, Rhoda Tinsley, Frank Tinsley, Sophia (Tinsley) Turner and Aiden D. Turner. Identified as Isaac Tinsley Sr.'s heirs and their legal representatives, the group included Isaac's children, the husbands of their married daughters, an attorney for one of their sons, the heirs of a deceased son, and a trustee for one of their daughter's children. The report of the Commissioners listed specific amounts of money and personal property received and/or owning to each.

All of the couple's children, with the exception of Sophia (Tinsley) Turner, had already received a portion of their shares from the estate before this final accounting, and allotments were made by the commissioners for balances due.

Moses Tinsley's allotment was made to his heirs.

Allotments were made directly to Richard Tinsley, Isaac Tinsley Jr., Thomas Tinsley, Bennett Tinsley, Rhoda Tinsley and Frank Tinsley.

Essenith (Tinsley) Powell's allotment was made to her husband, Thomas Powell, who by law was her legal representative.

Colby Tinsley's balance due was allotted to his father-in-law, Andrew Carpenter, whom Colby had appointed his legal representative.

Frank Tinsley, as the Trustee for the children of his sister, Sophia (Tinsley) Turner and her husband Aiden Turner, received the children's allotment.2 
(Son-in-Law) Estate and Land27 June 1822Commissioners were appointed in February 1822 by the County Court of Barren County, Kentucky, to divide and allocate the lands of Aiden's father-in-law, Isaac Tinsley Sr., deceased, to his heirs or their legal representatives. The widow's Dower had previously been set aside. Three of the commissioners submitted their report, which included a sketch of the ten allotted shares, to the court on 27 June 1822. Included in the allocations were the heirs of Isaac's deceased son, Moses Tinsley, and Isaac's nine surviving children, Colby Tinsley, Richard Tinsley, Seney (Tinsley) Powell, Thomas Tinsley, Rhoda Tinsley, Francis Tinsley, Sophia (Tinsley) Turner, Isaac Tinsley Jr. and Bennett Tinsley. Because his wife's sister, Essenith, and Aiden's wife, Sophia, were married, as was the law in those days, their allocations were made to their husbands, Thomas Powell and Aiden D. Turner, respectively, as their legal representatives. Our transcription of the Commissioners' report follows and the icon at the end will take you to the sketch of the boundaries dividing each allocation included in their report.

We, Alanson Trigg, James Matthews and William Edmonds, three of the Commissioners appointed by the County Court of Barren in the February Term 1822 to divide and allot to the Heirs and legal representatives of Isaac Tinsley, deceased, their respective parts in a tract of land containing 550 acres, met on the land aforesaid on the 26th of this Instant June and divided the same as follows, to wit and allocated:

No.1 to Moses Tinsley’s Heirs, Beginning at a beech and sugar tree near John Holeman’s fence and at the figure one, thence S 7 E 140 poles to a beech and white oak at 2, N 84 West 59 poles to two beeches at three, thence N 7 W 120 poles to figure 4 on the bluff of the creek, thence up the creek to the beginning, containing 55 acres.

No.2 allotted to Colby Tinsley and bounded as follows, Beginning at a beech and white oak, corner to No.1 and at figure 2, thence South 7 E 99 poles to the figure 5, a stake standing about eight feet north of a large poplar, thence North 84 West 63 poles to a stake in Turner’s field, thence N 7 W 99 poles to a stake and small dogwood at 7, thence S 84 E 60 poles to the beginning, containing 40 acres.

No.3 allotted to Richard Tinsley and bounded as follows, Beginning at a poplar in the head of a hollow at the figure 8, thence South 84 W 60 poles to two beeches at the figure 9, thence N 7 W 120 poles to figure 6, a stake in Turner’s field, thence South 84 E 63 poles to a stake, corner to No.2 and a figure 5, thence to the beginning, containing 45 acres.

No.4 allotted to Thomas Powell and Begins at the figure 10, thence S 7 E 94 poles to figure 11, a dead white oak, thence S 84 E 70 poles to figure 3, thence N 37 W 120 poles to a white oak at 4, thence down the creek to the beginning, containing 50 acres.

No. 8 allotted to Aiden Turner and bounded as follows, Beginning at two sycamores at figure 15, thence down the creek to a black gum at figure 16, thence N 83 E 178 poles to figure 17, a stake, thence N 7 W 60 poles to white oak, same course to the edge of the water, thence S 83 W with the line of No.7 to the beginning, containing 60 acres.

No.9 allotted to Isaac Tinsley, Beginning at a gum and beech at figure 13, thence N 7 W 206 poles to figure 17, a stake corner to No. 8, thence South 83 W 70 poles to figure 18, beech and ash, thence S 7 E 144 poles to figure 19, two hickories, thence down the creek to the beginning, containing 64 acres.

(Son-in-Law) Power of Attorney22 August 1822His mother-in-law, Jane Tinsley, with sons, Francis Tinsley and Colby Tinsley, daughters, Rhoda Tinsley and Sophia (Tinsley) Turner, and Aiden D. Turner, Sophia's husband and legal representative, appointed Jane and Isaac's eldest son, Richard Tinsley to represent them all, empowering him with a Power of Attorney, dated 22 August 1822, for the purpose of selling two specific tracts of land in Amherst County, Virginia. The legal authorization for Richard to act was prepared and recorded in Barren County, Kentucky, and our transcription of the document follows:

Know all men by these presents that we, Jane Tinsley, widow and relict of Isaac Tinsley, deceased, Francis Tinsley, Rhoda Tinsley, Colby Tinsley, Aiden Turner and Sophia his wife, formerly Sophia Tinsley, Heirs and Representatives of Isaac Tinsley, deceased, late of Sumner County, Tennessee, for divers good causes as thereunder moving have nominated and appointed Richard Tinsley of Sumner County in the state of Tennessee our true and lawful agent and attorney in fact for us and in our names and stead to transact all manner of business for us respecting the Estate of our late deceased husband and father, Isaac Tinsley, especially to sell, transfer and convey two certain tracts of land situate in the County of Amherst in the state of Virginia.

One tract on Otter Creek supposed to contain about 225 acres, the other tract situate on James River the quantity not certainly known. Our said agent or attorney in fact is hereby fully authorized to sell, transfer and convey all the interests, title and rights that we or either of us have in the aforesaid two tracts of land for such price as he may in his judgement think right and fit, to receive the price or value thereof and give receipt or receipts therefor, and further to execute and perform all manner of things that we might or could do in the aforesaid premises hereby ratifying all sale or sales conveyance and conveyances and all other acts and things which our said attorney may lawfully do in our names, making the same as binding on us and our heirs as if done by us in our own persons. In witness whereof we have hereunto set our hands and seals this 22 day of August 1822.

The signatures of Jane Tinsley and Sophia Turner were sealed with their X marks, and Francis Tinsley, Rhoda Tinsley, Colby Tinsley and Aiden D. Turner’s names were sealed with their signatures.

Hardin Davis and Thomas Winn, two of the Justices of the Peace for Barren County, Kentucky, signed their names as witnesses and authorized the Power of Attorney to Richard Tinsley. It was recorded in Barren County, Kentucky on 22 August 1822.7

(Father) Great Flood of 1913between 23 March 1913 and 26 March 1913 The Great Flood of 1913 occurred between 23 March 1913 and 26 March 1913, after major rivers in the central and eastern United States flooded from runoff and several days of heavy rain. Related deaths and damage in the United States were widespread and extensive. While the exact number is not certain, flood-related deaths in Ohio, Indiana, and eleven other states are estimated at approximately 650. The official death toll range for Ohio falls between 422 and 470. Flood-related death estimates in Indiana range from 100 to 200. More than a quarter million people were left homeless. The death toll from the flood of 1913 places it second to Pennsylvania's Johnstown Flood of 1889 as one of the deadliest floods in the United States. The flood remains Ohio's largest weather disaster. In the Midwestern United States, damage estimates exceeded a third of a billion in 1913 dollars. Damage from the Great Dayton Flood at Dayton, Ohio, exceeded $73 million. Indiana's damages were estimated at $25 million in 1913 dollars. Further south, along the Mississippi River, damages exceeded $200 million. Devastation from the flood of 1913 and later floods along the Mississippi River eventually changed the country's management of its waterways and increased federal support for comprehensive flood prevention and funding for flood control projects. The Ohio Conservancy Act, which was signed by the governor of Ohio in 1914, became a model for other states to follow. The act allowed for the establishment of conservancy districts with the authority to implement flood control projects.

John Reid and his wife, Nancy (Turner) Reid, with their three young children, were living in Hamilton, Butler County, Ohio, when, between Tuesday, March 23 and Thursday, March 25, heavy rains and rising waters from the Great Miami River burst levees on Dayton's south side and flooded 14 square miles of the city. Dayton's downtown streets experienced water 10 feet deep. On March 26, as floodwaters reached their crest, Dayton's business district suffered more damage after an early morning fire and gas explosion. An estimated 123 people were killed in Dayton. Downstream in nearby Hamilton, Ohio, about 100 people died after water 10 to 18 feet deep flowed into its residential neighborhoods.5,6 
Flood Victims*10 April 1913After her family’s harrowing experiences during The Great Flood of 1913 in Hamilton, Ohio, Nancy wrote to her father, David Y. Turner, in Adela, Clay County, Kentucky describing the ordeal. David shared her letters with a local newspaper, The Berea Citizen, Berea, Madison County, Kentucky, which, on 10 April 1913, under the heading, "Lost Everything in Hamilton Flood" published that The Citizen was in receipt of letters from Mr. David Turner of Adela, Clay County, written by his daughter, Mrs. Nancy Reid of Hamilton, Butler County, Ohio, stating that everything they possessed, with the exception of the clothes they had on, was washed away in the flood, and appealing to her father and brother for money to start to housekeeping again. The letters in part were as follows:

"Dear Father:
"A flood struck us Tuesday and lasted until Thursday evening. We were upstairs and the water was up to the last step and ready to come in on us. We had to go from our house to another through the windows, crossing on two bed rails. John had gone to work and did not get to us until Thursday when he waded in water up to his arms.
"We were in the house fifty-four hours without anything to eat and of course became very weak from the nervous strain and want of food.
"The flood came very unexpectedly, the largest reservoir breaking owing to a cloud-burst. We saved nothing but what we had on. We had just recently furnished our house.
"John was in another house which was struck by a floating house and knocked from its foundations. He caught to a telephone post and then swam to another house, and when it floated away swam to another and so on. He had no change of clothing from Tuesday until Thursday night, and part of the time his clothing was frozen on him.
"And we were not the only people to suffer this way. There were thousands of others, and just how many are dead cannot yet be told.
"The house I was in washed away about an hour after I was rescued. It is awful to think that we now have nothing for ourselves and little children. But, as I have said, there are many that are in the same condition.
"John saw a father pull three of his little children out of the water dead and lay them one by one on boxes. He has not found his wife and sister yet.
"We have spent all the money we had except $1.95, and I shall have to ask you to help us start life again. We will repay you as soon as we can.
"Your daughter, Nancy Reid, 30 West Fairview, Hamilton, Ohio."6
