As his Executors, he appointed his son Joseph and his son-in-law, Zachariah Emmerson, husband of his daughter Dianna, who, along with his other daughters, was not named. What follows is our transcription of Joseph Senior's will:

In the name of God Amen, I Joseph Sutherland Sr. of the County of Albemarle and State of Virginia, being in a low state of health but of perfect mind and memory, do make this my last will and testament. First of all I do commit my body to the earth, to be buried in a decent manner and my Soul to God who gave it in hope of a glorious Resurrection. Touching my worldly property after the paying out of my just debts, I dispose of that in the following manner.

It is my will that my wife Juda Sutherland be in peaceable possession of all my estate during her natural life and that my daughter Susanna Myers and her children live with her mother, and have a maintenance, as long as she remains a widow, and no longer.

It is my will that on the decease of my wife, what of my estate remains, whether lands, stock, household furniture, etc. be sold and equally divided amongst my children, counting in what any one of them may have received, and here I take the opportunity to mention that my son Joseph Sutherland has already received £37 3s and one hogshead of tobacco which I sold to Mr. A. Hart at $7 per hundred which he has to account for. I further mention that James Claybrook has had a bed and a house extraordinary which he is to account for at the price of £25.

I do appoint my son Joseph Sutherland and Zachariah Emberson (sic) as the Executors of this my last will.

That this is my last will and testament, witness my hand and seal this 7th day of March in the year of our Lord 1801, and his will was signed with the X mark of Joseph Sutherland and sealed in the presence of witnesses, William Irvin, Robert Garland and John Wilkinson.2,3
