Court Action*8 September 1924Myrtle filed a divorce action against her husband Frank on 8 September 1924 in Flathead County, Montana. Her Complaint for Divorce was submitted to the Court by her attorney, A. L. Hughes, and stated, "Plaintiff complains of the Defendant and for cause of action alleges:

"That Plaintiff and Defendant were intermarried with each other in Kalispell, Montana on the 21st day of November 1922, and ever since have been and now are husband and wife.

"That Plaintiff is, and for more than one year next before the filling of this complaint for divorce, has been a bona fide resident of the State of Montana, and is the innocent and injured party.

"That there have been no children born of said marriage.

"That the Defendant for more than one year last past has failed to provide for the Plaintiff the common necessaries of life because of his idleness, profligacy and dissipation, and that the Defendant is a strong able bodied man able to earn the sum of One Hundred ($100) Dollars per month and has at all times since the marriage of Plaintiff and Defendant been a strong healthy robust man and that during all of said time he has failed and neglected to have employment or to accept employment when the same was offered to him, refusing at all times to work except on two or three occasions has worked for a very short period of time, and has spent what wages he has made in gambling and in dissipation and has failed and neglected to furnish the common necessaries of life to the Plaintiff at all times since their marriage and that Plaintiff has supported herself and family of six children by former marriage with her own labor by raising truck garden and peddling and selling the same with her own labor and that the Defendant has failed and neglected to assist or help the Plaintiff in any way save and except a very small amount of labor in plowing her ground and has spent his time away from home at nights gambling and in general dissipation and has boarded and lived off of the Plaintiff's labor and secured the money for a large part of his own clothing from the Plaintiff.

"Wherefore Plaintiff prays that the bonds of matrimony heretofore existing between the Plaintiff and Defendant be dissolved and the Plaintiff relieved from any other or further obligation on account of this marriage."

The Complaint was signed by A. L. Hughes, Attorney for Plaintiff, and an affidavit made under oath and signed by Myrtle Howell on 8 September 1924, stated that she was the Plaintiff in the above and foregoing Complaint for Divorce; that she had read the same and knew its contents; and that the matters and things therein stated were true within her own personal knowledge. Both documents were filed by the Court on 8 September 1924.11 
Court Action10 September 1924A Summons was issued by the Court in Flathead County on 10 September 1924 ordering Frank to answer to Myrtle's Complaint for divorce. The Summons was served by delivering it to and leaving it with the Defendant, Frank Howell, personally, on 17 September 1924 in Flathead County.

When he had failed to respond to his Summons by 8 October 1924, Myrtle's attorney, A. L. Hughes, petitioned the Court to "enter the default of defendant, Frank Howell, for failure to appear or answer within time provided by law after legal service of the Summons and Complaint in the above entitled cause." The Court honored the request with a note to the Complaint for Divorce file on the same date stating, that in regard to Myrtle Howell, Plaintiff vs. Frank Howell, Defendant, "In this action the Defendant Frank Howell having been regularly served with process, and having failed to appear and answer the Plaintiff's Complaint on file herein, and the time allowed by law for answering having expired, the default of said Defendant in the premises, is hereby duly entered, according to law."11 
Divorce*11 October 1924Myrtle's divorce from Frank Howell was granted on 11 October 1924 in Flathead County, Montana. Her case was heard in open court and Myrtle, as the Plaintiff, appeared in person with her attorney, A. L. Hughes. There was no appearance by or on behalf of the Defendant, Frank, whose default for failure to appear or answer, was entered into the record. Myrtle and her son, Ed Fordham, testified in the matter, and the Court found for the Plaintiff, writing in part:

"... that the Defendant for more than one year next before the filing of the complaint for divorce has failed to provide for the Plaintiff the common necessaries of life because of his idleness, profligacy and dissipation and that the allegations of Plaintiff's complaint are true and that Plaintiff is entitled to the relief demanded in her complaint.

"Wherefore it is ordered, adjudged and decreed by the Court that the bonds of matrimony heretofore existing between the Plaintiff and Defendant be and the same are dissolved and the Plaintiff relieved from any other or further obligation on account of said marriage.

"Done in open Court in the City of Kalispell, Montana, this 11th day of October 1924."11 
Marriage*25 April 1925She married third, as his second wife, Charles B. Smith, son of Elihu S. Smith and May Higgins, on 25 April 1925 in Kalispell, Flathead County, Montana. Charles was 50 years of age, and Myrtle was 39 years of age with five children. Myrtle had been divorced for six months, and they were married eleven days after Charles's divorce from his first wife was granted.4 
Census US 1930*26 April 1930Myrtle Smith was enumerated as the head of her household on the 1930 census taken on 26 April 1930 in Jocko, Flathead County, Montana. She was recorded as divorced, 45 years of age, and owned and operated a farm. All seven of her children were enumerated with her in 1930. Among her Fordham children, Valentine was 22 years of age; Edward was 20 and worked as a laborer in a lumber mill; Dorothy was 14 years old; Rocko was 12; and Artybelle was 9; Myrtle's daughter, Blanche (Fordham) Grant was 17 years old, had separated from her husband and lived in her mother's household with her daughter Betty who was 1 year and 7 months old. Myrtle's youngest daughter, Myrtle Smith, was 4 years old. Rocko and Artybelle had both attended school within the census year.12 
Marriage*She have married, as her fourth husband, George W. Ritzman, son of William J. Ritzman and Isabella Shappell.13 
Residence*1940Myrtle M. Ritzman and George W. Ritzman had two listings in the 1940 City Directory for Kalispell, Flathead County. Their residence was listed as 1102 W. 6th, Kalispell. Geo W. Ritzman was recorded as a logger, and Mrs. Myrtle Ritzman was recorded as a cook at Wilson Cafe. George's widowed mother and two of his brothers were listed at 919 S. Main, Kalispell.14 
Census US 1940*1940Myrtle M. and George W. Ritzman were enumerated on the 1940 census taken in late June or early July 1940 in Kalispell, Flathead County, Montana. George was 48 years of age and worked as a teamster in the lumbering industry, and Myrtle was 53 years of age and worked as a cook, also in the lumbering industry. They were recorded as married, both reported they had lived in the "same place" in 1935, and both had completed the 4th grade of elementary school. They owned their house which was valued at $1,000. Myrtle's youngest daughter, Myrtle M. Smith, was also enumerated in the household. She was 14 years old, had completed her 2nd year of high school and was still attending school.15 
(Mother) Marriage11 September 1943When her daughter, Myrtle May Smith, married shortly before her 18th birthday, Myrtle M. Ritzman signed her approval as guardian and her daughter married Harvey Raymond Jensen on 11 September 1943 in Kitsap County, Washington.16 
Marriage*15 June 1947She married, possibly as her fifth husband, Theodore Robert Marshall, son of Ralph Marshall and Grace M. Lenhart, on 15 June 1947 in Kitsap County, Washington. Myrtle married using the name Myrtle Maud Smith, which may have been her actual legal name. She and Charles B. Smith may have simply separated and not legally divorced, and she may not have legally married George W. Ritzman. We will admit to surprise about the age difference between Myrtle, who was 60 years of age, and her new husband, Theodore, who was ae 28. It was his first marriage.17 
Death*15 January 1977She died on 15 January 1977 in Chehalis, Lewis County, Washington, at age 90.18,5

(Witness to Will) Will2 June 1803Ephraim Tilson Jr., James Crocker Jr. and Obadiah Lyon signed as witnesses to the will of John Hooper dated 2 June 1803 in Plymouth County, Massachusetts.1 
(Witness to Will) Probate4 May 1807Two of the original witnesses, Ephraim Tilson Jr. and Obadiah Lyon were with Ebenezer Hathaway when he presented the will of John Hooper for probate on 4 May 1807 in Plymouth County, Massachusetts. They both stated under oath that they had seen John Hooper sign and seal the document, and heard him declare it to be his last will and testament. Because Benjamin Cushing, originally selected by Hooper to be his Executor, had moved from the area, Ebenezer Hathaway was appointed Administrator and gave bond as required by law. Ebenezer was then instructed to return an inventory of the estate to the Judge of Probate and also to advertise for all persons owing debts or having claims against the estate. On the same day the judge appointed a committee consisting of Benjamin Pope, Nathan Hudson and Asa Thomson to appraise, under oath, all of the estate.1,2

(Fourth Party to Deed) Deed Memorial24 April 1822A memorial of an indented deed of annuity dated 24 April 1822 was made between Walter Thomas Hinds of Corrakane, County Cavan, Esq. of the first part, John Theophilus Howse of Farnham in County Cavan, gentleman of the second part, Jane Hinds of Corrakane, widow, of the third part and Humphrey Tilson of Corratober, County Cavan, gentleman of the fourth part. After reciting that Walter Thomas Hinds, for considerations mentioned, did grant, bargain, sell and confirm unto John Theophilus Howse, an annuity or annual sum of £65 a year chargeable upon the towns and lands of Corrakane, Kilmainham and Crahard in County Cavan. The annuity was to be held by John Theophilus Howse, his executors, administrators and assigns, for the life and lives of Walter Thomas Hinds and of Nathaniel Montgomery, Andrew Montgomery and Geraldine Montgomery and the survivors and survivor of them. Nathaniel, Andrew and Geraldine were described as the first and second sons and eldest daughter of Nathaniel Montgomery of Rutland Street, Dublin, attorney at law. The annuity was to be paid and payable on the dates identified in the original deed. Walter Thomas Hinds and Jane Hinds, for further considerations not described in the memorial, and to secure the punctual and regular payment of the annuity, granted, bargained, sold, devised and confirmed unto Humphrey Tilson, his executors, administrators and assigns, the several towns, lands and premises of Corrakane, Kilmainham and Crahard in County Cavan to hold in trust for the term of 99 years. The memorial then stated that the original deed contained several other recitals, clauses and covenants which were not changed by the memorial and were still in effect. The memorial was signed, witnessed and registered on 21 June 1822.1

Jessie reported on the 1940 census that she was divorced and that she and her daughter had been living in Sioux City, Iowa on 1 April 1935. Claude married his second wife in Nebraska in November 1935.5

Her income was $400 in 1939 and she rented her home, which was not on a farm, for $22 per month. Her daughter, Ellen, was 17 years old and had completed her education through the fourth year of high school. Her occupation was recorded as New Worker. They had lived in the same place, although not in the same house, in 1935.5 
Residence*1940 In the Sioux City directories for 1940 and 1942, Jessie and her daughter, Ellen, were both listed. They lived at 315 13th Street in 1940 and at 414 16th Street, Sioux City, an apartment house owned by Arthur D. Mackrill and his wife, Mary B., in 1942. Jessie's listing in 1940 reported her occupation as "waiter", and her 1942 listing described her as a "cateress". Ellen's listing in 1940 identified no occupation, and her 1942 listing described her as a stenographer for the A.Y. McDonald Manufacturing Company.7,8,9

She had completed her education through the 8th grade of Junior High, had no occupation, and in 1949 had received $3,000 from interest, dividends, pensions, rents or other income aside from employment earnings. Her lodger, Jessie Welsh, was 45 years of age, divorced, and worked as a waitress in a coffee shop. She had worked 40 hours the week before the census was taken.20,21
