Giambattista was 38 years of age and worked for wages as a cemetery laborer, and Maria was 35 years of age. They had been married for 15 years, the first marriage for each, and Maria had given birth to eight children, five of whom were living. They rented their house, and were both able to read, write, and to speak English. Their five surviving children were enumerated with them in 1910. James, who had both been born in Italy, was 14 years old, able to read and write, and had attended school within the census year; Louisa, who had been born in Italy, was 9 years old and had attended school within the census year; Lizzie and Flora were ages 4 and 3 years, respectively; and Henry was recorded as ten months old. Giambattista had immigrated to Ameria in 1901 and was an alien, and Maria, with James and Louisa, had joined him in America in 1905.3

Their years of immigration to America were reported as 1900 and 1903, respectively, and they had not been naturalized. Whoever provided the answers to the census taker did not know whether they owned or rented their house. Six children were enumerated in their parents' household in 1920. Lizzie, Florence and Henry were ages 13, 11 and 10 years, respectively, were all able to read and write, and had attended school within the census year; Thomas was 8 years old and attending school; and Victor and Johnnie were ages 5 and 3 years, respectively.4

The location of their house was described as being in that part of Ward 6 in O'Neal Township. Giambattista was 57 years of age and was employed for wages as a Gardener in a Cemetery, and Maria was 54 years of age and was employed for wages as a Cutter in a Cannery. Giambattista had been 25 years of age when they married, and Maria had been age 22. They were both reported to have immigrated to the United States in 1902, had not been naturalized, were both able to read and write, although neither was able to speak English. They owned their house, which was valued at $3,000 and was not on a farm, and did not own a radio set. Three of their children. all of whom were able to read, write and to speak English, were enumerated with them in 1930. Henry was 21 years of age and was employed for wages as a Caddie at a Golf Links; Thomas was 19 years old and was employed for wages as a Clerk in a Grocery Store; and John was 13 years old and attending school.5

Illness*June 1807It appears that in June 1807 Thomas traveled by river to New Orleans, Louisiana, and was planning to be away for some time. He then appears to have become ill, either there or on his way home, and may have borrowed money from his uncle Jeremiah in Maryland during that time. It also appears his wife Martha joined him for part of his way home because she was later reimbursed $4.98 by his administration for "my expenses and two horses for 6 days" from 14 April 1808. Thomas arrived home very sick, probably on 14 April 1808, and borrowed money from his brother Washington for his final expenses.1 
(Wife) Loan Agreement14 April 1808 On 14 April 1808, during his last sickness, Martha's husband Thomas Heaton received a loan of $15.50 from his brother Washington Heaton for the purpose of discharging his bills. Administration documents show that Washington's loan was needed immediately for $5 for a doctor and $10 for burial expenses.1

(Widow) Administration18 December 1809 On 18 December 1809, John Hardgrove appeared in person before H. Wallace, a Justice of the Peace for Washington County, to present a list of monies he was owed from the estate of Thomas Heaton. He stated he was owed a total of $35 and itemized the amounts beginning with $6 for cash lent to Thomas on 25 June 1807 that, for verification, was in Thomas Heaton's book by entry in his own hand in his lifetime. He was owed $3 for two days grading and two days mowing and hauling in hay in 1807, $20 for cash lent to his widow Martha Heaton on 3 April 1808 for her expenses when she went after him on his return from the Territory of Orleans, and $6 paid to Jeremiah Heaton to settle an amount Jeremiah had loaned to Martha Heaton on 13 May 1808 against the estate of her deceased husband Thomas Heaton.1 
Administration29 February 1812The final accounting for the estate of Thomas Heaton, dated 29 February 1812, reported a zero balance after a total amount of $1,848.62 in credits and debits. The itemized list of those who had received disbursements included two of Thomas's brothers, John Heaton and Washington Heaton, and Robert Clarke's name was listed next after Washington's. The document submitted and registered by the court in Washington County was signed by Martha Hardgrove and Duncan Campbell, administrators, and Isaac Kerr, Register.1

He first directed that the expenses of his funeral and last sickness and all just debts shall be paid as soon as practicable.

Second, he gave and bequeathed to his beloved wife Martha J. Spence to be hers absolutely, all of his clothing, household goods, furniture, domestic tools and utensils and $500. He did not devise to her any real estate because, in lieu thereof, he had already caused his homestead, to wit Lots One and Two of J. H. Spence's Addition to the said city of Warrensburg, to be conveyed to her absolutely.

Third, he gave and devised to his beloved daughter, and only surviving child, Catherine Braden, wife of Philip Braden, of Nameoki, Madison County, Illinois, absolutely in fee simple, and as her sole and separate estate, the following real estate situate in said Johnson County, state of Missouri, to wit the north one-third of lots forty-seven (47) and forty-eight (48) in Benjamin W. Grover's Depot Addition to the said city of Warrensburg.

Fourth, he stated his only other child was his beloved son, John W. Spence, deceased, and that he had assisted him financially to procure the farm he owned and upon which he resided at the time of his death. Therefore, his will gave and devised nothing to his son's children or lineal descendants, stating his son left surviving him twelve children, and some of them have perhaps double Christian names, but in mentioning them here from memory only, he would use but one Christian name for each. Namely, John, William, Edgar, Gentry, James, Roxanna, Katie, Jewell, and Robert Spence and Laura Shadwick, Irene Shadwick and Lucy Perry (or Peary) (or Parry).

Fifth, if after all the provisions of the foregoing sections numbered One, Two and Three are carried into effect there should yet remain some of his estate, he gave and devised the same, whether real or personal, to his said daughter Catherine Braden.

Sixth, in order that the cash may be derived to carry out the provisions of said sections numbered First and Second, to defray the necessary expenses of administration, he authorized and empowered his executor (or administrator with this will annexed) to sell and convey any of his real estate, except that herein devised, at the best price he can obtain, and without first requiring any order of Court or appraisement.

Seventh, he nominated and appointed William Shockey to be the sole executor of his will.

Research Notes*Several researchers have published reports indicating that Mary's surname may have been "Minor". Some sources have gone so far as to identify her as Marie (Mary) Minor, daughter of Thomas Minor and Grace Palmer, born on 5 May 1651 in New London, Connecticut.

Although we would love to know her actual identity, we know she was not that Mary. Marie (Mary) Minor, daughter of Thomas and Grace Minor, died on 24 Jan 1659/60 at only eight years of age.

Heaton Families: 350 Years in America" speculated, without offering any source information, that Mary may have been related to John Maynard, also spelled "Minor", her husband's mother's third husband. Again, although Mary was probably the right age to have been one of John Maynard's missing daughters, without documentation, we don't know.5,6,7,1 
(Possible Mother) Relationship NoteMary may have been the daughter of Nathaniel Heaton and Mary __?__.
